TELEHEALTH POLICY
Heffron Health & Wellness LLC | Luna Eclipsed Psychiatry
Effective Date: October 1, 2026
Telehealth allows psychiatric and mental health services to be provided using secure electronic communication technologies when clinically appropriate. This policy explains important expectations, limitations, and responsibilities associated with receiving services through telehealth.
PATIENT LOCATION AND ELIGIBILITY
At the beginning of a telehealth appointment, the clinician may verify the patient's identity, current physical location, and appropriate contact information.
Patients must be physically located in a state or jurisdiction where the treating clinician is legally authorized to provide the applicable healthcare service at the time care is delivered.
Patients should notify the clinician if their physical location changes during an appointment or if they are traveling outside the state where services are ordinarily provided. Being an established patient of the practice does not automatically authorize the clinician to provide care while the patient is physically located in another jurisdiction.
INFORMED CONSENT FOR TELEHEALTH
Telehealth services will be provided in accordance with applicable informed-consent requirements. Patients will have an opportunity to discuss relevant benefits, limitations, alternatives, privacy considerations, and other issues associated with telehealth.
Use of this website, requesting a telehealth appointment, or agreeing to website Terms & Conditions does not by itself constitute clinical informed consent for telehealth treatment. Required clinical consent will be obtained separately and documented as appropriate.
CLINICAL APPROPRIATENESS
Telehealth may not be appropriate for every patient, condition, circumstance, or visit. The treating clinician will use professional judgment to determine whether telehealth is clinically appropriate.
An in-person evaluation, a higher level of care, emergency evaluation, laboratory testing, physical examination, or referral to another healthcare professional may be recommended when clinically indicated.
PRIVACY AND PATIENT ENVIRONMENT
Patients should participate in telehealth appointments from a private, safe, and reasonably quiet location whenever possible. The use of headphones may provide additional privacy.
Patients should tell the clinician if another person is present during the appointment. The clinician may ask who is present and, when appropriate, document that person's participation.
Patients should not participate in a telehealth appointment while driving or operating a vehicle. If a patient is driving, the clinician may require the patient to safely stop and park before continuing the appointment or may reschedule the visit when appropriate.
TECHNOLOGY AND SECURITY
Telehealth involves electronic transmission of information and therefore carries potential risks, including interruptions, unauthorized access, technical failures, or other privacy and security concerns.
The practice uses telehealth technology and reasonable privacy and security safeguards appropriate for the services being provided. Patients are encouraged to use a private internet connection and a device they trust whenever possible.
Patients should protect passwords, portal credentials, and other account information used to access telehealth services.
TECHNOLOGY OR CONNECTION FAILURE
Patients should provide a current telephone number that may be used if the video or audio connection is interrupted.
If a telehealth connection fails, the clinician and patient may attempt to reconnect, communicate by telephone when appropriate and permitted, reschedule the appointment, or determine another appropriate method for completing care.
A telephone call following a failed video connection may not always be sufficient to complete the clinical service. The clinician will determine whether the encounter can safely and appropriately continue.
EMERGENCIES DURING TELEHEALTH
Heffron Health & Wellness LLC / Luna Eclipsed Psychiatry does not operate as an emergency or crisis service.
Because the patient and clinician may be in different physical locations during telehealth, the clinician may verify the patient's current physical location and emergency contact information when clinically appropriate.
If an urgent safety concern develops during a telehealth appointment, the clinician may take actions reasonably necessary to address the situation consistent with professional obligations and applicable law. This may include contacting an emergency contact, local emergency services, crisis resources, or other appropriate resources when clinically indicated.
If you are experiencing a medical or psychiatric emergency, believe you may harm yourself or another person, or require immediate assistance, call 911 or go to the nearest emergency department. For immediate mental health crisis support, call or text 988.
RECORDING OF TELEHEALTH SESSIONS
Telehealth sessions may not be audio recorded, video recorded, photographed, livestreamed, or otherwise electronically captured by the patient, family members, or other participants without the knowledge and prior agreement of the clinician and all other individuals whose consent is required.
The practice will not routinely record telehealth sessions. If recording is proposed for a specific purpose, any required authorization or consent will be obtained before recording begins.
PRESCRIBING AND CONTROLLED SUBSTANCES
Participation in telehealth does not guarantee that any medication will be prescribed, continued, changed, or refilled.
Prescribing decisions are based on clinical assessment, medical necessity, patient safety, professional judgment, and applicable federal and state requirements.
Controlled substances are prescribed only when clinically appropriate and when applicable prescribing requirements have been satisfied. The clinician may require additional evaluation, monitoring, records, laboratory testing, an in-person assessment, or other measures when clinically appropriate or legally required.
If applicable law or clinical circumstances require an in-person evaluation before prescribing or continuing a medication, telehealth alone will not substitute for that requirement.
PATIENT RESPONSIBILITIES
Patients participating in telehealth are expected to:
• Provide accurate identity, contact, and current physical-location information when requested.
• Participate from a reasonably private and safe environment whenever possible.
• Maintain an appropriate device, internet connection, and contact number for the appointment.
• Inform the clinician when another person is present.
• Provide accurate information regarding medications, symptoms, medical conditions, substance use, pharmacies, and other healthcare providers relevant to treatment.
• Notify the clinician of significant changes in symptoms or circumstances relevant to care.
• Follow agreed-upon treatment, monitoring, laboratory, and follow-up requirements when clinically appropriate.
LIMITATIONS OF TELEHEALTH
Telehealth has limitations and may not provide the same information available during an in-person examination. Technical quality, connectivity, environmental distractions, inability to perform portions of a physical examination, or other circumstances may affect the quality or appropriateness of an encounter.
The clinician may recommend or require an in-person assessment, laboratory testing, medical evaluation, emergency assessment, or another level of care when necessary for safe and appropriate treatment.
FEES AND INSURANCE
Telehealth services may be subject to the same or similar fees, copayments, coinsurance, deductibles, and other financial responsibilities as in-person services, depending on the patient's insurance coverage and applicable requirements.
Coverage of telehealth services varies by health plan. Patients are encouraged to verify telehealth benefits and financial responsibility directly with their insurance carrier. Insurance coverage or authorization does not guarantee payment.
RIGHT TO WITHDRAW FROM TELEHEALTH
Patients may communicate that they no longer wish to receive services through telehealth. Withdrawal from telehealth does not automatically terminate the provider-patient relationship; however, continued treatment may depend on whether an appropriate alternative method of care is available.
If telehealth is no longer clinically appropriate or cannot be provided in compliance with applicable requirements, the clinician may recommend in-person care, referral to another provider, or another appropriate treatment arrangement.
Withdrawal from telehealth will not result in retaliation or affect rights to future care except when telehealth is the only available method through which the practice can appropriately provide the requested service.
CHANGES TO THIS TELEHEALTH POLICY
This Telehealth Policy may be updated periodically to reflect changes in technology, clinical practice, professional standards, federal or state requirements, or practice operations.
The current version will be made available through the practice or posted on this website as appropriate.
This policy provides general information regarding telehealth services and does not replace individualized informed consent, treatment agreements, medication agreements, financial agreements, or other documents that may apply to a patient's care.
